By accessing or using this website or any services provided by Power Sports Management LLC dba Power Sports Management ("Power Sports Management," "PSM," "we," "us," or "our"), you agree to be bound by these Terms of Service. Power Sports Management provides recruiting advisory services for student athletes, including minors. This website and our contact form are intended to be completed by a parent or legal guardian (18 years of age or older) on behalf of the athlete. By submitting the contact form, you represent that you are at least 18 years of age and have the authority to submit information on behalf of the athlete named in your inquiry.
We do not knowingly collect personal information directly from individuals under the age of 18 without parental or guardian consent. If you are a minor, please have a parent or legal guardian complete this form on your behalf. Parents or guardians who believe their child's information has been submitted without their consent should contact us immediately using the information in Section 11 below.
Power Sports Management provides professional athlete recruiting advisory and management services, including but not limited to:
Specific service terms, pricing, and scope are outlined in individual service agreements provided at the time of enrollment. PSM reserves the right to modify, suspend, or discontinue any service at any time with reasonable notice.

You may opt out of SMS messages at any time by replying STOP to any message. Reply HELP for assistance. Mobile carriers are not liable for delayed or undelivered messages. Consent to receive SMS messages is not a condition of purchase or service.
Payment terms for PSM services are established at the time of enrollment. All fees are due in accordance with the payment schedule agreed upon in your service agreement. PSM accepts payment via methods specified at the time of enrollment. Failure to remit payment may result in suspension or termination of services.
To the fullest extent permitted by applicable law, Power Sports Management LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of our website or services. Our total liability to you for any claim arising out of or relating to these Terms shall not exceed the amount you paid to PSM in the three months preceding the claim.
Any dispute, claim, or controversy arising out of or relating to these Terms of Service or the use of our services shall first be addressed through good-faith negotiation between the parties. If the dispute cannot be resolved through negotiation within 30 days, the parties agree to submit the dispute to binding arbitration in accordance with the rules of the American Arbitration Association. Arbitration shall take place in Warren County, New Jersey.
These Terms of Service shall be governed by and construed in accordance with the laws of the State of New Jersey, without regard to its conflict of law provisions. Any legal proceedings not subject to arbitration shall be brought exclusively in the state or federal courts located in Warren County, New Jersey.
We reserve the right to modify these Terms of Service at any time. We will notify you of material changes by posting the updated terms on this page. Your continued use of our website or services after any changes constitutes your acceptance of the updated terms.
Your use of our website and services is also governed by our Privacy Policy, which is incorporated herein by reference.
